Kansas insurance companies have a good faith duty to investigate

Insurance companies have a duty to make a good-faith investigation of the circumstances surrounding a claim before refusing to pay a claim. When considering whether insurance companies acted in good faith, courts must consider the circumstances under which the insurer was investigating the claim. Insurance companies cannot be held to have acted in bad faith in denying a claim where plaintiff fails to establish damage to his or her property.
